Massachusetts is a no-fault state with a low threshold: you can sue for pain and suffering if medical expenses exceed $2,000 or if the injury causes disfigurement, fracture, or loss of function (M.G.L. c. 231, § 6D). This is much lower than Florida or New York. Modified comparative negligence with 51% bar.

No-Fault with $2,000 Threshold

Claim PIP first (up to $8,000). If medical bills exceed $2,000, you can sue the at-fault driver for everything including pain and suffering.
